    Default Will Disabled Wife Or Children Be Liable For Dying Father's Debts

    My father was just diagnosed with terminal cancer. He has $25,000 debt. My mother is disabled and cannot work. I'm 31 married. My sisters are also living in separate households. We advised him to file for Bankruptcy as soon as he can.

    Will my mother or his children be responsible for his debt?

    It depends on the nature of the debt. She shares responsibility for any joint debt. If he has any separate property which she would inherit, the credit card companies could attempt to make a claim against those assets after his death to satisfy any remaining debt that is only in his name.

    I am safe from the debt... even though I have the same name as he does.
    Will being named after my father cause any problems for me in the future.

    It could, but not because it should. My brother shares only my father's first and, of course, last name, but is not a junior. My father had financial difficulties many years ago and, from time to time, my brother has to fight the credit bureaus to remove information relating to my father on my brother's credit report.

    Thanks for all the advice.

    Can the children be held responsible for a hospital bill?
    This is the situation, my father is currently applying for medicaid. He currently does not have coverage. he is in the hospital receiving treatment.
    If the medicaid is denied, can I be held responsible?

    Unless you are agreeing to guarantee the debt if your father is unable to pay, you shouldn't have any responsibility for the debt.

    Same thing happened with my mother and father.
    He was diagnosed with stage 4 cancer.
    After his death, a couple creditors started comming after my mother.
    So, what she did, was she called, and asked for a credit card application, and asked them ( the same company that was coming after her), if she were to die, would her husband be responsible. They said no, and they put it in writing for her.
    She then took that, and used it against them.
    Trickery works.
