    Default Insurance Agent May Have Stolen the Insurance Premiums

    My question involves insurance law for the state of: michigan

    Hello. I go through an insurance agent who sells multiple types of insurance for multiple companies. He owns the business that sells these insurances.
    Ive used him for several years.
    Up until december of 2015 he had me with company A. It was 1590 a year. He called me in december when the premium was due and said he wanted me to switch to company B, which was 900 a year. I switched.
    A couple months ago my mortgager notified me of an escrow shortage. I called them and they said it was due to them paying 2 insurance premiums.
    So i called my agent. He said he would look into it. I called him back a week later. He said that insurance company A would be sending him a refund check because the policy was cancelled. A week later i called him and he said he is still waiting on the check. This has gone on for 2 months.
    I finally called tge actual insurance carrier. They told me they never recieved any premium on the policy.
    I called my mortgage company. They told me that they sent a check to my insurance agent in december, they gave me the check number and told me that he cashed it december 15th.
    So....
    Im guessing he cashed the check and took the money. That he was hoping i wouldnt notice the error. Now that i caught tge error he isnt paying me, probably because he already spent the money.
    What am i to do?

    File a complaint with the MI Dept of Insurance.

    Report the theft/fraud to the police.

    Sue him for the money.

    Find another agent.

    Be more careful about following up on insurance changes. Especially with mortgage companies. That's your responsibility. This wouldn't likely have happened if you'd been on top of things.
