    Default Can You Still be Charged With Shoplifting if You're Initially Released

    My question involves criminal law for the state of: Virginia. I went to target during my lunch break at work and I made the stupid mistake to steal. I took 3 items 2 phone chargers and 1 aux cord. I went and bought the something and checked out. Went to the bathroom and opened the items I only ended up taking the 2 phone chargers and left the auxcord with the two other empty boxes in the trash. As I was getting ready to leave the store a guy asked me about the merchandise that I took in the bathroom with me. I told him that I had dropped it off at the baby section and i told him to check my purse and bag of food and he said no it was fine that he wasn't accusing me of anything that he wanted to know where I placed the items so he could put them back in the shelf. I insisted for him to check my purse since I had hidden the charger in my bra. And he kept saying he wasn't accusing me of anything I got really nervous and he noticed and I used the fact that I'm pregnant as an excuse. I told him that I was just having a bad day because I'm having complications with my pregnancy (which is true) I asked if I could talk to someone ( I was planning on coming clean) and he apologized for causing me to get so nervous. I realized my lunch break was almost over and I told him I needed to leave and he said the manager shouldn't take much longer and he apologized for the misunderstanding. He said I could leave my phone number for her to contact me if I needed to leave. I told asked if it was just a misunderstanding if I could just leave and he said yeah and I left. I'm afraid that ithe act was on camera and that they got my plates on video since I parked close. Can they still Perdue chargers? Assuming he found the opened boxes and they have me on video. I know it was really stupid and I man afraid of charges since I'm pregnant.

    Perdue charges? They going to throw chickens at you? They certainly can make a complaint after you left the store. You'll have to wait it out. I'd stay out of that store (and for god's sake stop stealing). If the police or the commonwealth's attorney contact you, decline to speak to them without an attorney (though you likely will just find a summons taped on your door). Fortunately, you likely can get diversion if charged.

    yes, they can still pursue charges. They probably won't, but they can.
