    Default How to Evict My Ex-Boyfriend from My Home, No Rent Paid

    My question involves landlord-tenant law in the State of: TEXAS

    I recently bought a house in April. It is fully in my name. I paid for the down payments, mortgage, all utilities, and purchased every piece of furniture in it. My ex boyfriend has been staying over and we discussed him moving in, but do not have any lease agreements, etc. He did formally live with me before this house, but again not on lease, and did not pay one penny to rent or utilities. This was a verbal agreement to help him get on his feet. Of course it turned into him always over and I have been fully supporting him including groceries, for almost 9 months. I asked him to leave and wanted to break up. He is refusing.

    It is my understanding since he keeps clothes there, even though he doesn't pay, I have to "evict" him and serve him a 30 day notice. He has left to stay with his sister for a few days so that I can not "Serve" him. Can I just post a notice on inside of front door, take a picture and email it to myself as proof it was posted, whether or not he is there?

    He purposely left clothing behind, so that I can't say he moved out. Im not sure if I am allowed to bag it up, and say he has or change locks or what my rights are?

    I am trying to avoid an attorney, but at the same time, I have a child in the house (not his). He has been calling my phone like 30 times in an hour and texting me for last 3 days repeatedly, when I informed him I do not wish to be contacted in text message (written for record).

    If I have to serve him 30 days, what limits can I put on it? I have a guest room, can I say he must stay out of my bedroom (none of his things are in there) and that he has to use the guest room only? I tried verbally to tell him he needs to stay in the guest room, and he tries to sleep in my bed, and in addition after I put my child to sleep will come in and try to talk about our relationship in my room all night. Its to the point where I feel I need to have my kid sleep with me and lock my door so he cant bother me.

    What do I do?

    Does he receive mail at your address, have his driver's license show your address, or anything at all (other than some clothes) that shows that he lives at your address)?
