My question involves real estate located in the State of: Oregon
Long story short there was an adverse possession dispute over a small strip of land next to me. I won and got the strip of land (I was the defendant) and now that the weather is getting better I want to erect a fence between myself and my neighbors that sued me.
The tricky part is that there is already a fence down the side of their property - essentially I am replacing it because their fence is in such disrepair. It is falling down, has a section missing, is dangerous, etc. I can't open up my fence to let my children or dog play out back with their fence like that and their dogs run through their fence creating a dangerous situation.
I have people coming to do the fence in a couple weeks but some of their fence has started leaning onto my property.
When I go to have the contractor put the fence in can I just push the leaning fence back onto their property?
Should I contact my lawyer and have him write a letter and tell them to get the fence off my property before X date?
I need to make sure my fence posts set in the concrete without his fence leaning on them.
