    Default Does a Tenant Have the Right to Carpet Replacement While in Residence

    My question involves landlord-tenant law in the State of: California, city of Glendale

    I live in a city with no rent control. However I do live in a HUD (not Section 8) subsidized apartment. My program is not completely based on age or income but people with certain medical disabilities. I have lived in this same apartment for 11 years. The carpeting was put in new when I moved in. It was however more like office carpeting, no nap, hard, no padding. After this time span the carpeting to so soiled and grimy that it is hard to tell the color in all major pathways and living areas. I have brought in professional carpet cleaners two years ago but it did not look any better. After this much time is the landlord obligated to replace the carpeting? I broached the subject casually about 4 years ago and she said no.

    By "soiled and grimy" you mean that it is clean but that due to its age and the extent of wear it is stained and unattractive? But there are no open seams, no areas where the carpet is worn through, no trip hazards, etc.?

    If the worn carpet is not a hazard and there is nothing in your lease requiring its replacement then, no, the landlord has no legal obligation to replace the carpet.

    If you want it replaced you are free to pay for it yourself. You'll need written consent from the landlord and you'll have to choose carpet that meets the landlord's limitations.

    The alternative is to give notice that you are not renewing your lease when it expires unless the carpet it replaced and then find another place to live.

    That might give the landlord the incentive to replace the carpet as she is likely going to have to replace it anyway after you move out otherwise she will have difficulty renting the place to somebody else.

    Another idea might be to invest in good quality area rugs that you could take along if you ever move.
