You are still married, yes - but I think you'll have one hell of a time trying to convince a court that you need alimony.

For the purposes of SSI Only, if yo can prove that you are no living under the same roof, his income will not be counted. For SSDI, it will depend on how many work credits you have. How are you supporting yourself now ? Income and resources Only matter with SSI. You will also have to meet the SSA medical requirements for disability. If you are under 50, they will look at jobs in the national economy that you can do. So if you are under 50, they may find that you can no longer do your previous jobs but that there are other job on the national economy that you can do,
