    Default When Does a Doctor Have to Report a Crime

    My question involves malpractice in the state of: Florida.

    my ex-wife has been taken my son to the dr for last two years. She take the dr.s note for my son and adds my other kids name to it so she don't have unexcused days in school. my son uses a dr. that my other kid is not even a patient at the practice. from what I read in fla.stat. 831. it is a folony charge in 3ed degree for altering/forging the paper and another charge of uttering. the kid added to the dr not should have been in school.
    I have showed the dr the notes and they agree they have been changed from original. can the dr get in trouble for not reporting it? how do I go about reporting it? thanks for the help.

    Even if we assume that the doctor believes you, that is not the sort of offense that a doctor is obligated to report.

    If you want to try to report your ex-wife to the police, you do that by making a police report.

    Florida Statute 831 is the statute for Forgery and counterfeiting. Of the 37 chapters contained in statute 831, which one do you think applies to altering a doctor's school excuse?...and what makes you think that a DA would even be inclined to prosecute?

    Altering an excuse for a child's school absence is not the same as altering a prescription.
