My question involves landlord-tenant law in the State of: Wisconsin
Hello again!
The answers to my own personal question got me looking in the right place, so this time I am looking for some input on a situation that is occurring with a friend.
My friend (tenant) has a month-to-month rental agreement with the property owner/landlord. He has 2 roommates (subtenants) with whom he signed subleases. One of the roommates has already given proper notice and will be out at the end of May, so is unaffected by the issue. The other intends to stay until the end of June. All 3 live on the property and split bills and rent in thirds.
The landlord gave the tenant a written notice that he needs the house for his family, and that he wants everyone out by the end of July. The notice was received on April 27th and copies were shared with the 2 subtenants. The notice also states that the landlord will consider the premises surrendered upon return of the keys and removal of all property, and rent will no longer be due. Tenant has located a new living situation that works for him, but would need to move in on June 1st to take it.
Since one of the subtenants wants to stay until the end of June, can tenant actually leave and surrender the lease prior to that? Is the subtenant forced to leave then, even though if they were served notice today it wouldn't be effective until the end of June (WI statute, also term of sublease)? The affected subtenant is also not keen on being on the hook for 100% of the bills, should he be allowed to stay by himself in June, so would he be able to pursue some kind of rent due from tenant?
Basically, what happens if the tenant chooses to move out on June 1st and is cleared of all responsibility by the landlord?
