    Default Procedure Tests and Reports

I have a simple couple of questions perhaps someone can shed some light on fo rme.. I have research and was unable to find a firm answer..I have 2 Doctors..Both Neurosurgeons..One is in Wis.. one is in Michigan..I was injured in Wis and yes i have a W/C claim already in process.. But anyhow on to my questions..I had seen my Doc here in Mich with the same complaints as prior to surgery and yet they are worse now then before..Laminectomy fusion w/hardware..Severe low back pain radiating down right light and left leg numbness..He had sent me for a CT Myleogram..I was to see the Doc in Wis for a check up and he requested i have a BoneScan done to see how the bone was growing and if there was anything wrong.I had the tests done within the same week so i know not much change could occur within a cpl day period..I had received a disk with the myelogram pictures on it but no report..Doctor who ordered that test said everything was fine there was nothing wrong..When i had mentioned to him that i had a bonescan that which was ordered by the other Doc..He refused to look at them and read the report..My PCP went ver the bonescan report withme and stated that the scan showed loosened screws and a build up of tissue on the right side of L5-S1..Can a Doctor legally refuse to review another Doctors tests reports when it clearly shows problems???

Yes, a Physician can legally refuse to look at diagnostic test results ordered by another Physician.

    Sun-flower,

Malpractice refers to any professional misconduct that includes an unreasonable lack of skill or unfaithfulness in carrying out professional or fiduciary duties.

Negligence is the failure to meet or a departure from the recognized standard of care.

I believe the question was, "Can a doctor legally refuse to review another Doctor's test reports.....". The answer is simply, yes they can.

Simple answer: No one knows or can guess.

If a physician refuses to acknowledge a radiology report that states their is loose hardware that might cause permanent damage to nerves, that doctor has breached a duty to care for hi/her patient.

He did not order the test, and did not examine you on the day the bone scan was ordered, therfore it would not be appropriate for him to discuss the test results. Was there any communication between Neurosurgeon #1 & #2 regarding your treatment/condition before Dr. #2 was made aware of the bone scan results?

Appropriate and inappropriate are terms used to describe "medically desirable" and is not used in a legal context such as duty to patient by attending physician.

Please explain how/what the significance is betw a second opinion provided by Neurosurgeon #2 and his discussion with Neurosurgeon #1 before a test was done in a legal context?
