    Default How to Evict a Housemate from a Home You Own

    My question involves landlord-tenant law in the State of: Michigan

    I bought a house several months ago and had a friend move in with me, it had become apparent for several reasons this was not a good idea and I had asked him to move out. There is no lease agreement and my name is on all the utilities and the paperwork for the home. I had talked to him at the beginning of March about moving and he reluctantly agreed, and I told him he had until May 30th. I have since then given him a signed and dated letter stating my issues with him and why and when I wanted him to move. Since then it seems as though he has made little to no effort into finding a place to go or working on getting his things out.

    My main question is that since I have already told him he had until the end of May to leave, do I have to wait till then to try and get an official eviction notice, or can I go at the beginning of May and make sure that he is out by the 30th? also since he has stopped paying me rent would I be able to get a 7 day notice?

    Your notice to quit must meet specified statutory requirements you will have to check the statutes to see if your letter meets the requirements. Here's what the standard form notice looks like.
    Quote Quoting MCL 600.5716. Demand for possession or payment; form and contents.
    A demand for possession or payment shall be in writing, addressed to the person in possession and shall give the address or other brief description of the premises. The reasons for the demand and the time to take remedial action shall be clearly stated. When nonpayment of rent or other sums due under the lease is claimed, the amount due at the time of the demand shall be stated. The demand shall be dated and signed by the person entitled to possession, his attorney or agent.
    If your tenant's rent is overdue, yes, you can also serve a 7-day notice and potentially proceed on that notice if rent remains unpaid. However, you have to be careful about filing a case solely on non-payment, as if the tenant pays rent you'll have to start over.

    The problem isnt the rent money, I honestly dont care about that, I just want him and his mess out of my house. After looking at that link for a standard notice, that looks nothing like mine, here is what I said (not using names)

    "roommate"
    It pains me to have to do this to a once good friend, but you have not respected my wishes and continue to break the rules of the living arrangements offered to you. I hereby serve notice of eviction. You must leave my property by May 30, else legal action will be taken.
    During your time as roommate you have consistently disturbed me and coming home at all hours of the night disturbing me when I have to work in the morning and welcoming uninvited guests in to the property without even speaking to me. Refusing to clean up after yourself and making the house a disaster.
    As you are not a legal tenant nor have been pay rent, there is no lease agreement, and as such you are a guest who has now been uninvited. In effect you are trespassing on my property and I am well within my rights to notify law enforcement.
    I hope it doesn’t have to come to that and you will find somewhere else to live within the time given.

    So im guessing that once again, ill have to fill that out, print off like 3 copies and tape it to his door just so he can be pissed, wad it up and throw it down the stairs like he did with the above letter I gave him.

    Here is an update on my situation,

    I have given him the notice to quit, filled out and left tapped to his door. that was at the end of April, he has shown no signs of getting ready to move or has been looking for a place to go. I am wondering if there was anyway to "speed up" this process, I have taken picture of some evidence of my complaints in case they are needed.

    I am just fed up with him treating me and MY property like its his to do with as he pleases, like throwing my clothes out of the dryer to wash his, slamming doors when im trying to sleep before work. Any help would be greatly appreciated!!

    I have also just remembered, in the process of thinking of things he's done to try and get him out ASAP, I know of and have witnessed him selling some of his prescription pills, Adderall to be exact. I am worried that it is now after the fact that if i bring this up in trying to evict him I would get in trouble as well.

    I have only been with him once when he made a transaction, and was unaware that was the purpose for going to one of his friends houses. Any advice on this matter would be greatly appreciated!
