Pennsylvania does not have a statute governing late fees for residential real estate, so you will need to start by reading the late fee provision of your lease. Absent something in the lease or law that prevents your landlord from doing so, the landlord can apply your subsequent payments to your late fees before applying the balance to your rent.

My son had $35.00 in late fees. He didn't have enough money to pay them the next month. So the landlord charged him another $35.00 on top of those late fees ( He paid his rent on time for that month, but didn't have enough money again to pay the late fees. The same thing happened the third month, and so on. Now somehow he owes !51.00 in late fees. He works like a dog all week and living paycheck to paycheck is a reality for him. I can't help because I'm in the same boat living on disability.
I'll give you an example of how this works.
Rent of $500 due the first of the month, no grace period.
January's rent not paid on the first, incurs a late charge of $35. Rent for January is now $535.
If only $500 got paid in January, the rent is still late because it was only a partial payment.
On February 1, February's rent is $535. Your son makes a partial payment of $500. February's rent of $535 is late and incurs a late fee of $35.
On March 1, March's rent is $570. Your son pays $500 towards the March rent but pays it late and incurs a late fee on the $500.
On April 1, your son's rent is $605.
You see how that's going. Some states prohibit that method.
PA apparently does not.
There is also nothing in the statutes that say collecting partial rent waives late fees.
It's unfortunate that you and your son live paycheck to paycheck but he needs to find the money to bring his rent up to date if he expects to avoid eviction for non-payment.
Thank you for your speedy reply! I see what you mean now and will let my son know. He has be LUCKY enough to be asked for some overtime this week-which is a super rare occurance!
