    Default How do Drunk Driving Repeat Offender Laws Work

    My question involves criminal law for the state of: MS,I was arrested for DUI and reckless driving a week ago and charged with a first DUI but I also had another DUI in November 2012,isnt it supposed to be 5 years for it to reset back to a first,how is this do they just count by the years and not the exact number of days to make up 5 years?

    It runs five years from the offense date to offense date. Note that just because your initial citation doesn't mention that this is your second offense, doesn't mean you won't be sentenced that way at trial. You need a lawyer.

    I already blew into the breathalyzer with a BAC of 0.18,theres no way I can fight it with a lawyer.I was curious because when the arresting officer told me what I was being charge with and I mentioned the other DUI and he said got lucky with the time,also I was booked in by the sgt at the jail as first DUI and the bondsman had the same report.

    You are ignorant in addition to being drunk.
    You NEED a lawyer.
    Again, nothing prevents the prosecutor or the court from realizing the error and correcting it.
    But if you're willing to roll over and take the worst, continue being stupid. But please, stay out from behind the wheel if you are going to continue to have an alcohol abuse problem.

    I didn't realize that I was dealing with a tough guy who sits in a safe place and writes insults over the internet.

    Ditto - speak to a lawyer. The prosecutor will almost certainly discover the prior and charge you appropriately.

    It also seems pretty clear that you have a problem. I doubt that this is only the second time in all these years you drove impaired. As such, it may well be time to do some serious soul-searching and get some help.
