    Default Joint Legal Custody and Enrollment of a Child in School

    My question involves a child custody case from the State of: Michigan

    I just found this site searching Google so I'm not sure if this has been answered already.


    I have physical custody of my minor child (she's three) and share joint legal custody with her father. He barley sees her and lives out of state. She went to spend two weeks with him and told me he put her in school (which he confirmed)

    He didn't mention this to me and went behind my back to do so. Joint legal custody means we make those decisions together and therefore he doesn't have the right to do so without consulting with me first, correct?

    I have no idea where the school is, the name of it, the phone number, if he listed me as an emergency contact, if they know he doesn't have custody of her...

    I want to make sure I'm correct in these decisions are made jointly before bringing it up with him.

    With a child at the age of three, although you say "school", is this question about his use of a child care center or daycare to look after the child while he works, during visitation?

    Right now, I don't know.

    It's a weird situation. He works from home and his family is there during the day.

    My question isn't so much her being put in school/daycare while he's working because I understand that, it's more him doing it without telling me anything about it beforehand because he doesn't have custody of her.

    Joint legal custody according to the agreement we have states no decisions regarding medical & education be made without the other parents consent.

    And yes, during visitation in a different state than me (he's in Florida)

    So what you're actually bothered about isn't what he wants to do, but more that he hasn't asked for your permission yet ... right?

    Joint legal means he's allowed to make day-to-day decisions regarding his child, just as you are. He can choose his own daycare if he pleases, without consulting you.

    Absent something to the contrary in a custody order, a parent's child care arrangements during his or her parenting time is his or her own business. They can hire a babysitter, use a child care center or daycare, get help from friends and relatives....

    Actual K-12 school enrollment is another thing entirely, but it's safe to say that if you're the primary custodian and the father is in another state the school your child will attend is going to be local to you.

    Are you saying that he put her into "school" for the two weeks that she is going to be with him, or that he has put her into school and does not intend to return her?

    If its the former, you have nothing to gripe about, he has the right to do that. If its the latter, you need to go get your child (taking your custody paperwork with you) as soon as she doesn't come back.
