    Default Rent Liability when Leaving Early After 30 Day Notice to Quit

    My question involves landlord-tenant law in the State of: Michigan

    Hello!

    My landlord has sold the house I'm renting, and I have been given a 30 day notice to quit. (Technically, he said we would receive the notice on the 1st of May, meaning we have to be out by June 1st.) Fair enough. My question is, if I end up moving out before June first, do I still have to pay all of the rent for May? I feel like if he is the one giving the notice, I should be able to leave whenever, and only pay rent for the time I lived in the house. I'm having trouble finding the specifics of this situation in the Michigan laws.

    Also, if anyone can find the specific statute relating to this, that would help.

    While you can move out whenever you want, you will still owe rent for the full month of the notice period.

    There's no "law" that addresses this.

    You pay for the month on the first of the month.

    Any other arrangement is between you and your landlord.

    Ask him if he's willing to prorate the May rent based on your actual move out date.

    If he says yes, get it in writing.

    If he says no, then it's up to you whether you want to stiff him and risk the consequences.

    If you are a month-to-month tenant, you can give your own thirty-day notice and move out at its conclusion, without owing rent past that date. However, if you choose not to give notice, your tenancy will end based upon the notice provided by your landlord. You will owe rent through the conclusion of your tenancy, even if you move out before your tenancy is over.
