    Exclamation Marrying a Minor While Being Prosecuted for Rape

    My question involves criminal law for the state of: Oklahoma
    My Fiancé is being accused of rape by his ex girlfriend. They have a 18 month year old son together and I believe that she cried rape to take their son away from him. He is 19 and I am 16. Both of my parents are giving consent to our marriage but he is afraid that our marriage will effect his court case. Is it possible for him to go to prison for marring me?

    Unfortunately getting married at 16 is perfectly legal if your parents agree. It won't affect his current case, but I'm going to give you a warning.

    STOP. THINK. If he truly loves you, he'll wait until this is all over and dealt with before he drags you into this mess. You're a child.

    "Crying rape"? I'm dreading the day you come back here trying to terminate his parental rights when he gets you pregnant and you break up.

    All you know is what he told you happened with the mother of his child. By the way I'm glad that you're ok with him probably having to pay child support at some point in the future. Most young girls would want that money for themselves and their children by him.

    The word is AFFECT by the way. His court case has already apparently been effected. But I agree with the other posters, your "fiancee" is likely a rapist and most definitely a liar.

    You know that feeling you get when a thread just hits you up the wrong way? Yeah, me too. This one set off several warning signs and I think we're all of the same mindset.

    We don’t have any facts on which to base those kinds of assumptions. Some women do make false claims of rape after all. Not a majority of them, but some do. Leaping to those kinds of assumptions based on no facts does no one any good. I’d want to see the evidence presented in the case before deciding which of the two, the fiancé (and yes, that is the correct spelling for a man engaged to be married, whereas a woman engaged to be married is a fiancée) or his ex-girlfriend, is the liar. Just because the state charged him doesn’t make him guilty, after all.

    The lying wasn't limited to the rape charge. I suspect his blaming his not getting married on his legal situation IS. I bet he's still using the promise of marriage to have sex with the minor poster here.

    Where there's smoke, there's usually fire - and there's so much smoke here I can't even see.

    Regardless of what is actually legal, normal grown men don't have an interest in 16 year olds. I don't care that he's "only" 19. The difference between 19 and 16 isn't akin to the difference between 33 and 36. It's a cavernous, world of difference. At 19, one should be into the college phase of their life, looking forward to legally drinking, working a job, etc. One shouldn't have a desire to fool around with someone who just got to legally drive.

    Of course, it might be tempting, even with that being the case, to say "oh well, but he DOES. Maybe he's immature, but it's legal." But then we add the rape allegations into the mix.

    This forum, while dealing with legal issues, isn't itself a court of law. Things don't have to be proven beyond a reasonable doubt HERE for us to know what life experience clearly tells us.

    The guy is a scum bag and a rapist. OP would do well to listen to the people here just a little bit older than her. This goes beyond "legal" advice - this is advice to attempt to help someone not screw their life up.
