    Default Rent Increase at the End of the Lease Term

    My question involves landlord-tenant law in the State of: California
    The Apartment we have lived in for 12 years is looking to increase rent from 1035 to 1175. They did so by not renewing the lease. The lease has a provision that without lease rent 1175. We received a 30 day notice of rent increase as a notice of not renewing the lease. California rent law says that any increase over 10% needs a 60 day notice.

    They claim that since it was in the lease they did not have to give 60 day notice. That seems to be a sloppy way of avoiding the 60 day requirement. Is the 30 day notification of non renewal just a 30 day notice of rent increase.

    What can be done.

    Well, that gave you plenty of notice. So I'm not sure anything can be done (except move).

    However, does the lease specify a notice requirement for non-renewal?

    If it does, please quote it word for word.

    If it doesn't, then your tenancy may have defaulted to month to month at the increased rate as of the expiration of the prior lease.

    If that's the case, then you are free to give your 30 day notice and move.
