    Default Possibility of a CPS Visit After the Police Came to My House

    My question involves police conduct in the State of: Kentucky.

    Police walked in house over noise complaint said he smelled marijuana he fount a couple small things nothing big no arrest no charges but he mentioned cps coming to the house. What should I expect what will they do or say

    When you say, "he found a couple small things", do you mean he found your drug paraphernalia? Actual drugs? Roaches lying around where toddlers could reach them? Were there other issues in the home as well -- e.g, no food in the home, a dirty home, hoarding, visible neglect of the children, etc.?

    Be aware that you do not have to answer the door or let CPS into your house unless they actually have a warrant or the child is in immediate danger.

    Of course not letting them in can lead to more trouble (certainly in the short term), but it's still your right to refuse access.

    Depending on the situation, they can remove the children or do nothing and several things inbetween. If the police had thought that the children were in immediate danger, they could have called CPS and removed them when they came to your house. But, that does not mean that CPS won't decide that they need to be removed.
