    Exclamation Can a Roommate Move Your Property Out

    My question involves personal property located in the State of: California

    Long story short, I made a mistake by moving in with my (now ex) boyfriend. We got into an argument, and he told me to move out. We had talked about it for a while, but things got really heated and violent a few nights ago and he said I needed to move out that night, at 9 p.m. He threw my things (clothes, books, printer, etc.) out on to the porch and kept them out overnight. I returned today (when he wasn't home) to get them, and nothing looks damaged except maybe a book or two.

    I was never on the lease, but he was. It was actually kind of sketchy because the landlord didn't know I lived there, but I did pay rent and used it as my address for a lot of things. Did he have the right to kick me out in one night and put my things outside? He threw them, even spit on them, and, like I said, things got violent. I got scared and left after putting a few things in my car.
    I didn't pay rent for the new month, but told him I'd prorate it for as long as I'd live there for April. When I went for my things, he had my deposit in an envelope but took out two days for April plus $10 for a dinner that we ate together over the weekend (just to make me mad, but whatever).

    I guess my questions is, what legal right, if any, did he have to touch my things and kick me out without fair notice? He asked me when I was moving out, and I didn't have an answer for him, and that's what led to the conflict. I had to stay the night at a family member's and thankfully found a place to stay for a few days and already found a new apartment. But he basically rendered me homeless at 9 p.m. on Saturday night and in no way do I think that's legal. I am very upset and traumatized over what happened, and would like to file a small claim.

    He shouldn't have kicked you out. If you paid him rent, you were his subtenant and he should have followed eviction law. However, if you have no economic damages there's not much point in suing him, as opposed to moving on with your life. Sure, you could sue him for the right to move back in, but... really?

    No, I definitely don't want to do that. I just had heard from a friend that what he did was illegal, and wanted to further research it.
