    Default Texting Somebody Who Has Asked You Not to Contact Them

    My question involves criminal law for the state of: Ny and FLA

    I'm in NY and Bout year ago i was talking to this woman in FLA. Never went anywhere but just sort of ended.

    While clearing out my phone i found her number few montsh ago and sent her a text just saying hi but from a diff number using (Hushed). She got all angry said stop stalking me when she had no idea it was me. Nothing was said that was vulgar or vile. Zero threats. Sort of just let it go.

    By accident (being drunk that is) other night I Just sent her text saying Hi and she went off teh deep end. She said stop texting me I said okay never agin, sorry didnt mean to, was by accident. Said she was going to report me to cops. Claimed she called sherrifs office.

    Is there any grounds for a charge. I know i was stupid, know its idiotic, but figured I would ask.

    Highly unlikely, but if she did contact law enforcement, there's now a record of it.

    This means that if you're a complete idiot again, they may pay a visit at the very least.

    Delete her number.

    Perhaps you should just delete her number and then you will not drunk text or accidentally or purposely text her ever again. That is what I would do.

    She may have called the police or is just saying that. Some people say that just to get someone to stop texting or calling. I would think if she had filed a report they may have come and talked to you by now.

    I would just delete her number and forget about it.

    Two text messages sent months apart simply saying “hi” is not going to be a crime in any state. If that was truly all there was to this then she overreacted big time and going to the police will be a waste of time because they’ll tell her there is nothing they can do about this. But now that she has made it clear to you she doesn’t want to hear from you the text messages should end. Continuing to text her after that might end up crossing the line into illegal harassment at some point.

    You're not just a fool, but apparently a bad drunk. Maybe you should avoid drinking or you might get yourself in serious trouble in other ways.

    Drunks often do other foolish things, like drive and get DUIs.
