    Default When Can You Be Charged With Multiple Crimes for One Incident

    My question involves criminal law for the state of: Oklahoma.

    Can you be charged with assault with a deadly weapon and making violent threats?

    Can you be charged with both crimes for the same act. As I understand it assault is a threat with no contact. Which is the same thing as making violent threats?

    The proper question is not whether you can be charged with multiple offenses, but whether you can be convicted of multiple offenses.

    In Oklahoma, double jeopardy analysis involves the court's examination of whether each offense requires proof of an additional fact that the other does not. If the court answers that question in the affirmative, the defendant may be convicted of both charges.
