    Default In Collection from a Debt for Medical Care After an Accident

    My question involves collection proceedings in the State of: Pennsylvania

    I have just received a bill for the first time about 3 weeks ago for a motorcycle accident I was in, in the amount of 8999.00. My other bills were paid through my blue cross and blue shield along with my motorcycle insurance. Some how this bill never got submitted with my insurance at the time, so I spoke with them. I gave them the information and member number I had at that time with BCBS and I found out today the insurance wont pay it b/c its past the limitations for the hospital to submit a bill. Now they want to come after me for the full amount. I offered to make payments but they wanted an astronomical amount each month. So I asked if I can make my own payments and they said yes, but it will still eventually fall into a a collection status b/c "their minimum" payments weren't being made.
    So since I never received a bill till now can they do this to me?
    Can I still go to collections if I make payments on this of what I can afford?
    Should I go see a lawyer and if so, what kind of lawyer do i speak to?
    Any help is greatly appreciated

    Why wasn't the bill submitted to your insurance in a timely manner? Did the provider have your insurance information at the time? Were they, at the time, in-network or out-of-network?

    I don't know why it wasn't submitted, but they are a in network provider

    You need to investigate, because if they had your insurance information and failed to bill the insurance company in a timely manner they may be contractually precluded from attempting to collect the money from you. Your insurance company may be able to assist.

    It can but it might not. Start sending as much as you can as often as you can.

    A lawyer will cost you $300+ per hour. That would be a waste of money since you owe for the bill anyway.

    Was this employer sponsored health insurance, and if so what kind of plan was it? HMO, POS, PPO, High Deductible, Indemnity?

    It may make a difference to your options.

    I was in the process of switching jobs at the time, but it was a ppo plan through my employer which I already had but moved to cobra and paid(400.00 a mon) for a few months till my new coverage began at my new job

    Okay, that's not the answer I was hoping for. It's not impossible but it's definitely worth a shot. It's still managed care even if it is the lowest level of management.

    Call BCBS. Ask to speak to someone in the Provider Relations area - NOT Claims or Member Services. This will not be an area you have talked to previously. If you are in NE PA the number may be 1-800-451-4447; if you're in a different area of PA that number still may be able to give you the number for the right office. Explain to them exactly what happened.

    It MAY be, and I am not making you any promises but it is most definitely worth your while to try, that since the provider was in-network and did not submit the bill on a timely basis, that you are not responsible for the balance. It would be more likely if you were in an HMO or even a POS, but it still could be - it will depend on the wording of the provider's contract with BCBS. Provider Relations will be able to determine if that is the case.
