    Question Making Terroristic Threats While in Possession of a Firearm

    My question involves criminal law for the state of: california

    what are the likely sentences for the following charges?

    No one can really say. Sentencing is determined by a review of all the facts of the case, which we don't have, as well as any bargaining done by the defense and prosecution. It could range from nothing in the extreme to the maximum allowable time for each charge. Looking at what the actual charges are, I'd guess a lot of probation and probably some jail time. All we can do is guess though.

    if the 'minimum' is 18 months for a charge does that really mean 18 months in california?

    does a previous felony make it more severe?

    one of these is a gun charge


    im waiting on a full police report. the defendant is 31 years of age.

    Prison time - or, at least extended local time - is likely. These are serious charges. Criminal threats combined with possession of a firearm by a prohibited person and DUI equals trouble.

    This defendant should speak ONLY with his attorney. Anyone else can be called as a witness against him. A plea deal is likely in his future, and he can probably expect to spend a year or more in custody coupled with extensive probation and protective orders protecting his victim(s).
