    Default Statute of Limitations for an Old Phone Bill

    recieved letter saying I owed a old phone bill in illinois that I am resposible to pay from 1992 (337.62) I told them I have never gave authorization for any phone to be put in my name.
    collection company said they bought it from verizon and sinse they did, I now owe it!
    is this bill my obligation to pay or does it fall under statue of limitation for michigan or ill and do i have a right to file a federal law suite(due to over state lines), to collect punitive actions against them. I also told them not to call my house or my job. there replie is that they can attempt to collect a debt. please replie your beliefs thanks, bluesman

    Michigan's borrowing statute provides,
    Quote Quoting MCL 600.5861 - Cause of action accruing without state; limitation on commencement of action.
    An action based upon a cause of action accruing without this state shall not be commenced after the expiration of the statute of limitations of either this state or the place without this state where the cause of action accrued, except that where the cause of action accrued in favor of a resident of this state the statute of limitations of this state shall apply. This amendatory act shall be effective as to all actions hereinafter commenced and all actions heretofor commenced now pending in the trial or appellate courts.
    So the Illinois limitations period should apply.

    so you are saying that i am not entitled to pay based on ill statue nor can they collect in michigan either. after 15 years? thanks for the replie!

    Hey, I had the EXACT same thing happen to me last week also!!! I received a "collections notice" stating that I owed 347.45 on an old phone bill. I contacted the collections company and told them I never opened/authorized nor had any phone service with Verizon in my life.....they said the date on mine was 1991! I found this posting when I was googling for statute of limitations. I sent the collections agency a dispute letter. Now seeing that this exact same thing is happening with someone else, I'm getting a bit concerned......

    hello, I requested the paper work showing I turned a phone on in my name! they are full off """""" limitation law does apply and what is a hold status they are talking about.! I plan to file a class action suite against them if they continue trying to ruin my credit. are you willing?

    one more thing! afni told me, since they bought the gebt from verizon, it now starts over. I adviced it doesnt make a differance if you did or didn't. the law applies! bluesman00@sbcglobal.net

    Where I am unsure of limitations on bill here is something they can and often do. When you seek new phone they ask for deposit of ........you guessed it past bill! I had a BK of a phone bill it had gone past the limitations time line but when I tried to get phone service in my name they asked for deposit it amount of my old bill.

    bluesman, you need to calm yourself. You have given no reason you would have a calim against the creditor. They do have the legal right to attempt to collect a debt. If they have reason to believe the debt is yours, that gives them the right to attempt to collect it from you.

    The SoL is an affirmative defense to a suit for collection of a debt. You can inform the creditor you are awqare it is beyond the SoL but that does not prevent them from inititating a suit to recover the money, especially since there are some states have statutes that toll the SoL and may be applicable.

    If sued, you must defend with a SoL defense and/or a defense of it not being your debt.

    It would be a good idea to request validation of the debt along with notification that you believe the SoL has run.

    This may cause the creditor to stop collection efforts. If they believe it is your debt still and the SoL has not run for some reason, they may still inititate a suit for the ebt, which you would then need to defend against.

    NO, the time period for the SoL does not restart simply because somebody purchased the debt. It is still the original timeline that is of concern.

    A lot of these collections companies will illegally reage the debt and put it on your credit report. The CRA's allow this even though they know it is illegal. Simply send them a new dispute letter every thirty days and eventually it will be taken off.
