    Default Exchanging Pictures With a Minor Who Lied About Her Age

    My question involves criminal law for the state of: New york
    so yesterday morning i matched with a girl on a dating site. she messaged me first and said hey, i said hey what are you looking for on here, she said i don't know i said i'm looking for fun, because i am moving out of state soon. i immediately asked how old she was, she said i am 19, i said nice i am 20. i said i would like to see more pics of you, (she only had 2 blurry pics on her account) she said how can i send them on here, i stated we would have to text because there is no way to send pics on there. so she gave me her number, we starting texting later that evening. so i said are you gonna send any pics? she said sure anything specific? i said whatever you think i would like. so she sent me a pic of her in a bathing suit type thing. nothing completely nude. i sent a pic of my abs back to her. she then said i want to know what you would do to me, i came back and said everything. then i asked for a face pic of her ( i kinda wanted it all along i just didn't specify to her) so she sent one and then i sent one back. i said you're cute. so then i said we should meet up that night because it was my day off of work and i was bored. she said i can't tonight but maybe the next day. i said okay cool. she said i can go to her house around 4pm. i said i can't wait to hang with you, she said i know me either. so then she asked for my snap chat, we snap chatted for like 15 minutes of just our faces nothing special. or nude. i then asked her over text where she works, she said a restaurant, as the night was about to end i wanted to be 100% sure she was of age, and for some reason i had a gut feeling to ask. i said i know this is weird but i want to see a pic of your ID or passport or high school diploma or something to prove you're 19, she made excuses of how she cant find it and what not. she said she would look in the morning, i asked for her birthday and she gave me a date which would make her 19, but it wasn't enough proof. i then took her first name off the dating site and her last name off snap chat and googled her name, it says she is in the class of 2018, which would make her normally 15-17. so i asked her if she can be honest with me and tell me her real age, she kept denying that she was that young. but i didn't believe it, i immediately deleted the pic of her in a bathing suit. what could i be charged with? i'm sooooo scared my life is over or an officer is going to show up any minute. what do i do? i already called a lawyer they said they can't do anything at the moment. i'm literally shaking and have been since i saw her real age.

    If I understand your facts correctly all you did with this girl is chat with her via text, exchange some photos, none of which involved nudity or were sexually suggestive, and you apparently went out on one date with her and talked with her. You made no mention of having any sexual activity with her. It’s not illegal for an adult to chat with a minor, or to exchange photos that do not involve nudity or are sexually suggestive. It is not illegal meet with a minor and have dinner, see a movie, or talk.

    It is illegal for you to send or receive nude/sexually suggestive photos/videos of anyone under age 18. That's child porn and is a serious federal offense and also an offense under the laws of some states. The age of consent in New York for sexual activity is 17. Having sexual activity with someone under age 17 may be a crime. Note that you don't have to know the person is under age 17; it just matters what the person’s actual age is. So if she lies, that’s no defense. So you were smart to ask for proof of age here.

    If you didn't engage in child porn activity or sexual activity with her then you don’t need to worry about any criminal charges here. Just forget about her and look for someone else. If she starts out lying about her age, there is no way you could trust her anyway.

    this makes me feel a whole lot better, thank you very much, so you wouldn't consider me and her saying i want to do everything to her sexual? i just feel like i did by her asking what i would do to her and me replied by saying everything. we never even met once in person. it was all over via text and snap chat. no pic showed completely nude, just abs and her in her bikini or braw and panties whatever that was. she also did say she can't wait to kiss me but i didn't reply to that statement, that is around the time i asked for her age.

    the charge i was so terrified to get was sexual solicitation of a minor.

    It’s not a crime to talk about sex with a minor. (Though her parents might not like you engaging in that kind of talk with their daughter and that might cause you some grief if they found out.) What is potentially a crime is actually doing something sexual with the minor.

    When you get a text from her father demanding a large sum of money, that's when you should be scared...because that's when you'll know you've fallen victim to a very very very typical scam.
