    Default Failure to Drive on the Right Side of the Road

    I was driving on I-405 good-to-go lane yesterday around 6 pm (crazy traffic and crazy rains). I got this ticket---violation code 46.61.100. The officer pulled me over, and said that I was driving 55 mph (the maximum limit was 60 mph), and I was supposed to drive on the right side of the road.

    I admitted that I was driving slower than usual, but it was the rain and water on the road which made me really uncomfortable driving faster. And cars on the general purpose lanes were trying to merge onto the right side of good-to-go lane. I was so scared to drive on the right side of the lane. However, I didn't say much before the office took my driver license and registration. I thought he was going to give me a warning. I was shocked when he came back with a $136 ticket. Then I tried to explain my concerns to the officer, but all he told me was that he needed me to take the ticket.

    I felt so upset ...can't believe I got a ticket by driving carefully. I wonder if there is any chance that I can get this ticket dismissed by explaining my situations to the court. I know people here are generous and kind. I hope someone could advise me on how to fight my ticket. I would be really really appreciate!

    What state is this? There is an I-405 in CA, but, the code section you mention is not a CVC section. So, if this IS California, what city or county were you in as that would appear to be a local code.

    I can tell by context the OP is referring to I-405 east of Seattle. The weather was indeed crazy yesterday, and 46.61.100 is from the Revised Code of Washington.

    Buttercup321 if you have not already be sure to read the sticky thread Procedural Guide to Traffic Tickets in Washington State. Your best approach is to request a contested hearing and request discovery—holding all further decisions until after viewing the officer’s sworn statement. If you would like forum members to view your discovery materials and assist further, redact identifying information (including the citation number), upload to an image hosting site and link the images in your thread.

    Yeah, we're pouring down rain here, too ... maybe not in L.A. where OUR 405 is, but, the weather here has been crazy. I'm drenched!

    You should probably pay the ticket and move on. All the officer needs to write down in his notes is that he saw you in the left lane and you weren't passing anyone.

    There is literally no way in God's green earth that you're getting out of this one.

    Pay the fine. And keep right except to pass. It's a simple law that very few seem to follow.

    Still I would think it’s better to at least appear and ask for a deferred finding (assuming eligibility), and meanwhile it doesn’t hurt to check the statement for possible errors or omissions.
