    Default Television and Captive Markets

    Hi, I currently live in WV, in section 8 housing. The apartment complex that I live in is structured in a way that makes it impossible to receive regular television broadcasts without an exterior antennae, which is strictly prohibited by the lease. The only other option is to buy cable service, of which there is only one company to choose from. Our lease further prohibits satellite dishes from being placed on the building, or on the grounds.

    We recently had a 3 month long dispute with the cable company, resulting in us voluntarily discontinuing our service. We now have *no* means of receiving television. Is there any way we can force our landlord to provide us with another means of service(I.E. by changing the lease to permit satellite dishes)? Is this a captive market, or against the law?

    Default Receiving Broadcast Television Signals

    Presumably the apartment complex wasn't constructed with the intention of preventing you from receiving broadcast television signals, even if it has that effect. It is a shame that the landlord isn't willing to accommodate tenants by simply installing a large, common antenna that could be accessed by all units.

    If the landlord has an actual deal with the cable company, and gets some form of kickback or commission for having tenants sign up, you may be able to make the case that the landlord is interfering with your rights. Section 8 leases also afford tenants certain rights beyond what are typically available under state law.

    Is there a tenant's union, or similar organization, in your community which might be able to provide some specific guidance about your situation, and the content of your lease? Or in the alternative, might a legal aid attorney assist you?
