    Default Naturalizing Based on Marriage After Mistakenly Filing Taxes as Single

    Hello,
    I have been married for 5 years and have been an LPR for 3 years now. Since we've been married, we always filed taxes married filling jointly - except last year, since he was deployed for 7 months and was out during tax season, I filed my taxes as head of household. We talked about filing for my citizenship this year and I was putting our information together and realized that the box was checked for Single on my tax return last year. This was an honest mistake and I plan to amend it when we file for taxes this year even though I will probably owe this year since my husband was out of the tax zone last year. My question is, how will this affect my filing for citizenship on the basis of marriage?

    Amend your taxes now to correct the error. The IRS doesn't much care as long as you fix things before they catch you. CIS doesn't care if the IRS doesn't care.

    Amend it to married filing jointly. That is the safest way to resolve the problem.

    His base should have a tax office staffed with volunteers supervised by a paid staff who assist service members with taxes. They are trained with deployment tax issues. As far as I know from DD who volunteers ar her DH's base, services are free.

    Head of household was not appropriate for you either. The only appropriate statuses for you would have been married filing jointly or married filing separately...and married filing separately probably would have been a bad idea.

    Again, amend 2014 to married filing jointly and deal with whatever tax fallout there is regarding that.
