    Angry Relocation of a High School Student to Another State

    My question involves a child custody case from the State of: IL
    I am the NCP of two children, a 15 year old and an 18 year old, both still in High school. My 18 yr old has been living with me since October, the 15 yr old with her father still. The father stated he was going to move to Texas and that my youngest would be moving with him. I stated we would have to come to some agreements before this happened and get it in writing. Now it was also stated that she would finish the school year and summer in my care and then would move after. Nothing was ever put in writing...he never had time to meet with me. Since then I have found out he has already moved himself to Texas, minus coming back at the end of the month for house closings and never informed me or ensured that our daughter was with me. She has been living with his best friend who is a single man. WHat do I do????

    You sue him for custody. Go pick up your child. Do you live in the same school district as your daughter? How often do you see your daughter?

    The father has been talking about moving to Texas for about a month, no specific plans as to when though. This was supposed to be one of the things we discussed so our daughter would have moved with me when this took place. I just found out yesterday, he left over the weekend and never told me.
    I am not in the same school district, but I have spoken to the school and they will allow her to finish the year since there are only a few months left to it. I see her every two weeks....to say that my daughter WANTS to live with me would be a lie. SHe has complete freedom, no curfew, etc with her dad...with me there would be structure.

    Why are you on a forum and not in an attorney's office? The fact you know she is living in an inappropriate environment and have done nothing does not speak well for you.

    T53147 - Oh my goodness. Why on earth is her staying with a single male "inappropriate"? Are you automatically assuming he's going to molest her? There are PLENTY of wonderful, loving, NORMAL men out there. Good golly.

    OP, have you spoken to your ex to hear what the plan is? Obviously your 15 year old is eventually moving with her dad and you seem to be okay with it based on your original post. You just assumed she would finish out the school year living under your roof and then the summer with you as well. My view is, if you don't have first right of refusal then this may all be above board. She stay's with your ex's BF to finish out the year, you still get your every other week visitation and the summer. By the way, is it written in your custody agreement that you actually get the summer with her or was that just a verbal between you and your ex? If it was just a verbal, he doesn't have to comply.

    My suggestion is that you quickly get to a lawyer to have your agreement amended. Do you want your daughter to live with you? If so, request it. His moving away will undoubtedly affect your access to her. If you don't want her full time then you at least need to have it amended to state a new visitation schedule with him paying all travel expenses.

    A 15 year old staying anywhere without both parents' knowledge is inappropriate. A young woman staying with a man not a immediate relative is suspicious - and dangerous.
