Default Possession With Intent to Deliver Charges in Pennsylvania

My question involves criminal law for the state of: Pennsylvania

Hello- I was wondering if anyone could answer my question: My boyfriend was charged with Possession with Intent to Delivery in Pennsylvania. His Gravity Score is a 2. He has served 4 months on the sentence as of today. He was left out on a Bail Reduction Hearing when he had 80 days in. He had missed a court date and is now back in jail. This is what happened a detective had called him 3 months after he hung around with his high school buddy, I guess his high school buddy had got into some trouble and turned my boyfriend in stating he had sold him about 30-40 Xanax 1mg which is a CIV.

His gravity score is a 2. (My boyfriend) He was never arrested that day while hanging around with his friend when he had the Xanax on him. He just received a phone call from the detective and then next thing I know he's in prison. My boyfriend sates he partied with a few friends and they took them.

Does anyone know what kind of time he might be looking at?

About 15 years ago I had the same charge without and priors and got a 6-23 1/2 month sentence.

I had sold two OxyContin 80mg to a CI which was a friend of mine and is not anymore. They were going to give me Drug Court but then had changed their mind. I had no priors, I was about 29 years old. I know they like to take younger people into the Drug Court Program.

What do you think his sentence will be? I mean the were only CIV and he was not arrested that day. He has a Public Defender that thinks he can do something about this b/c there is really no evidence besides this CI has turned in half of his friends.

If anyone has any idea on how much time they think he will get, please respond. His court date is in about a week.

    Thanks,

    JMH

People are allowed to rat out their friends. If he is found guilty, he can expect to get up to 14 months (less the time he actually has already served).
