    Angry Falsely Accused of Stealing from a Supermarket

    My question involves criminal law for the state of: Pennsylvania

    Last week, while I was shopping at a supermarket, I was approached by 2 cops and escorted to an office to the right of the Customer Service counter.
    The 2 cops handcuffed me and said that I was being detained because (according to a store manager) I am suspected of stealing some flowers from the store 3-4 weeks ago. Of course, I DID NOT DO IT. I have never gotten any flowers for anyone in the past 3-4 years. I always shop at this supermarket, at least twice a month, for GROCERIES.

    I don't know--maybe I looked similar to whoever it was that did the crime...but again I did not do it.

    I was detained in police custody for about 40 mins in the store, and then taken to the police station where I was detained for another 15 mins.

    They finally released me because the supermarket did not have any video of me taking anything from their store. And I was told to never return to that supermarket.

    So, instead of me attending church prayer's service and doing some work in the church, I lost at least 1 hour out of my night, due to some ridiculous B.S.!!!!

    I've already fired off a letter to the corporate headquarters complaining of this unfair treatment, not to mention the embarrassment of being handcuffed AND the mental stress that I had to endure.


    Any thoughts?

    They're free to ban you from their store even if you didn't do anything. You're not getting your hour of life back (or compensation for it). People are allowed to make mistakes (I'm sure you have done so at some point in your life).

    About the only relief you're going to get is if corporate choses to issue an apology.

    They can certainly ban you. The Pennsylvania shoplifting law allows the store to detain you if it "has probable cause to believe that a specific person has committed or is committing the retail theft". It is not clear to me that applies to a theft they observed 3 weeks ago. It might be worthwhile to talk to a local lawyer about whether a suit for false imprisonment is justified.
