    Default Minor Caught Shoplifting, Repeat Offense

    My question involves criminal law for the state of: Montana
    Was caught for shoplifting at Walmart the merchandise was worth 118 and a cop gave me a ticket and said I had to appear at court by a certain date. I am a minor and was caught for shoplifting 3 years ago. (I know stupid me). My first offence i did not receive a ticket and i only had to talk to someone not appear in court and they had me pay a fine of 100 dollars , and They said if I dident do anything for 2 years my offence would be dropped off of my record. Now my question is;
    1) will my first offence reappear or can they see my first offence since it was wiped of my record?
    2) will I be able to make my second offence dropped of off my record?
    3) Do I need an attorney and if i do can i get a free one that is provide for the people who cant pay for one?
    4) will this effect my FASFA for college next year?
    5) once i turn 18 my juvenile record is sealed right? so no one will be able to see it like when I need to get a job when older?

    Without knowing exactly what "they" meant by "dropped off of [your] record", we cannot tell you the significance of that statement in relation to further court proceedings. If you are charged in the same court where you were previously prosecuted, you should anticipate that the court will know about the prior incident and that the prosecutor's office may have records of the prior case in its files.

    That's a discussion to have with your lawyer. You should anticipate that nobody is going to believe that you stopped shoplifting between the first time you got caught and this time.

    You can talk to your parents about getting a lawyer, or having them help you petition for a court-appointed lawyer.

    Fortunately for you, this has nothing to do with FAFSA.

    If your case is continued past your 18th birthday, it will not be sealed until your case ends.
