    Default Hit by a Car While Making a U-Turn

    If someone involved an accident while making U-Turn like he hitted by some other car who came so fast in this circumstance who will be at fault?

    First off, what state was this in?

    Second, what happened? Did you make a U-turn in front of a "speeding" car, and that car struck you? In general, a car making a U-Turn is liable if they are struck by an approaching vehicle - even a speeding vehicle. But, a lot will depend on the nature of the roadway and the speed of the approaching vehicle. A straight away where you either did not see the approaching car or misjudged the distance, will be entirely on you. A speeding vehilce (say, 50 in a 25) rounding a curve only a few feet away, not so much.

    Of course, if the U-turn was illegal where you made it, then that changes things, too.

    One more thing.

    If there were no independent 3d party witnesses to another driver's adverse driving behavior it's likely that the driver making the U-Turn will be assigned 100% of the fault.

    What would happen if the U-turn driver had a green arrow and collided with a car making a right turn on red? (I'm NOT saying the OP mentioned that or that ANYTHING in the OP's post implies that.)

    The driver with the red light would likely be at fault as he would have had to yield.

    The reason I pointed out that scenario is that I've seen it almost happen a number of times. The right turn driver will likely look to the left for crossing traffic and slightly left for opposite direction left-turn traffic but frequently miss the U-turn traffic.

    Well they would be negligent, then. Nothing says that U-turns and even left turns from the opposite directions might legally have the right of way over his turn.

    Though the party with the green light, or without the obligation to stop and yield (as with a right turn on a red light) will generally be at fault. However, one might have to see the scene, the damage, and the specific fact set to make that determination.

    Who do you mean by "they." I assume it's the right turn driver in my example, but you've warned me about the dangers of assumptions, and this is one of those. Maybe you mean the U-turn would be negligent?

    I meant the RIGHT TURN DRIVER (They is not ambiguous be cause it was a response to YOUR assertion that the driver wasn't looking). A right turn driver on red that doesn't look at ALL TRAFFIC that might be an issue is negligent. It is NOT the case that traffic crossing from right-to-left in front of him is ALL the conflicting traffic. The U-turn and potentially other traffic may indeed have the green lights or otherwise have the right of way over what he is attempting.
