    Default Remedies for Breach of a Patient's Bill of Rights Law

    My question involves civil rights in the State of: Florida

    Hi, I'm a newbie here, thanks for reading. Florida Statutes Title XXIX Chapter 381 "Florida Patient's Bill of Rights and Responsibilities" are these Civil Rights? Like, is a breech actionable under Civil Rights Law? The nonprofit corp's annual report says they get 7% of their funding from "Federal Grants and Contracts".

    More specifically, it is Florida statutes section 381.026. This section lists out various rights that a patient and 381.0261 requires that health care providers give a summary of these rights to patients. The failure to provide the summary of rights is punishable by a fine assessed by the relevant state regulatory agency. The statute does not give patients any civil remedy for violations of the patient’s bill of rights however. Simply put, you cannot successfully sue a health care provider for a money judgment simply because the provider violated some provision of the patient’s bill of rights.

    Depending on the circumstances, however, perhaps some other civil claim might apply. What happened and what harm, if any, was suffered as a result?
