    Default Tax Refund Taken Due to a Spouse's Student Loan Debt

    The government took all my income for my wife students loans, she work like 10 days last year and I don't own anything to them is there anything I can do?

    I’m going to guess that you and your wife filed a joint federal income tax return and that the entire refund from the return was offset to the Education Department to pay for your wife’s student loans. You may be able to get a portion of that refund sent to you by submitting a Form 8379, Injured Spouse Allocation, to the IRS. Read the instructions for the form carefully and submit the form as promptly as you can.

    I would agree since he filed in the tax forum. However, there is also the possibility that their joint bank account was levied, and in that case, I would recommend that he immediately get a separate account and have his wages deposited into the separate account.

    Yes, it was because he posted in the tax forum that I made the guess I did. If they had a joint bank account attached then to figure out what might be done it would matter in what state they reside, in what state the account is located (if different) and whether it was truly the Department of Education or the lender itself that attached the account.
