    Default Concerns About Child Neglect in a Messy House

    My question involves child abuse or neglect in the State of: Missouri. After my brother and his girlfriend broke up last year she took both of their girls with her to her parents house. And now I am worried about them because I've seen the way her and her family lives and I've their house first hand and I know its a mess. When her and my brother were together and living with my parents she left dirty diapers EVERYWHERE and dirty dishes piled all over the place. Now she lives wither her parents, her brother, and I think her aunt with the girls in a small, run down three bedroom house. And her and all her family members smoke and around the girls no less. the girls are 2 and 1 years old and don't need to be around that. And she keeps the girls from seeing and of my family including their father because she hates him and therefore us and wants to see us hurt. And to top it all off she seems to almost ignore the younger of the two because she is my brothers kid, she looks like him, and she hates my brother. I'm worried about them and I want to know what I can do to get them into a better living situation.

    He says that he's talked to lawyers but because she still occasionally allows him to see the girls, though it is very very rare that she does and constantly holds it over his head that the older of the girls isn't his and he has no right to her even though she know his as her dad, he's afraid to pursue it because he's afraid he'll lose his ability to see them both.

    He won't do anything about neglect because he's scared he won't see the children?

    That shouldn't even be a consideration. They're either neglected, or they're not.

    He needs to hire one of those lawyers he talked to and get an enforceable court-ordered visitation plan in place for his child, the one he's the legal father of. You have no standing in this. You can help your brother with legal fees. If you truly feel the children are being abused, you can call CPS.

    A messy house doesn't mean that the children are at risk. One person definition of messy doesn't mean that it is a threat to the child. If the children have medically documented healh issues that being around smoke worsens their condition, that is one thiing. But, health children being around family members that smoke doesnt mean that they are at risk. It is always best to not smoke, especially around chidren. But, that isn't the same as the risking their health.
