    Default Defamation by an On Duty Police Officer

    My question involves defamation in the state of: Texas. Is it legal for an officer that is on duty, in his uniform, to falsely say that a city councilman paid 3000 dollars for me? He made this comment in our local BBQ restaurant

    Illegal? Probably not. It may be against his department policy. You're free to make that complaint to the department. Of course, if it is actually in the course of investigating something, police are allowed to lie to people to elicit information. There's not nearly enough information here.

    As to whether it is civilly actionable would depend on whether he knew the statement to be false, who he said it to, and what damage you suffered as a result.

    No it certainly is not! Anyone with access to the internet can very easily find what Crystal Reisner posted here, and use it against her in court should she decide to sue either the councilman who purchased her, or the police officer who talked about it.
