I wanted to sublease an apartment due to job opportunity and the need to relocate. My lease agreement states "consent must not be unreasonably withheld provided that the prospective assignee or subtenant satisfies established standards set forth by Landlord/Agent for all prospective tenants including, but not limited to, a credit check, rental and employment references and Tenant's payment of a $400 service charge, which must be fair and reasonable, defraying Landlord/Agent expenses incidental to processing the application for assignment or sub tenancy".
The owner did not consent to our request for sublet claiming he would be in violation of his mortgage document. As such, I am wondering if she is unreasonably witholding consent since as a tenant I am not a party to her mortgage document. There is nothing else in the lease agreement that would require me to abide by the terms of her mortgage. Does that constitute an unreasonable witholding? Or am I a party to her "mortgage document" that I have not even seen and he refuses to show me?
