Default Can You Evict Your Ex-Spouse Under the Lodger Law

My question involves landlord-tenant law in the State of: California

The mother of my children and I broke up we were never married. I own my house and told her she could stay till she got on her feet. well a year and half later she is still there on the couch. Does the Lodger Law fit this situation or do i need to Evict her?
