    Exclamation What Can You Do if Your Roommate Kicks You Out of His House

    My question involves landlord-tenant law in the State of: Michigan

    Hello, long time watcher, first time poster. Quick little background. About 2-3 years ago my "friend" offered me to move in into his house if I accepted the help him with the dogs and any house projects he had. Basically I helped him with the house before I moved in, and then he offered since he had a spare room. I was about 20 at the time and going to school. I should note as well as long as I helped him with the house and dogs it was free rent, he just wanted to help me get a head start in my life, which I greatly appreciated at the time.

    However now, 2+ years later, things changed. I've lent him $3,000+ because he lost his job first and now he is on a medical disability so he needed a little money. He promised me that he would pay me back (rent was still free) and not to worry, so I lent him the money. Some of it was cash but some was charged on the credit card, like a $1,800 fridge (he's a little outrageous). But now things have gotten a little worse, we are not in the best of friendship terms and he wants me out (although he hasn't fully said it yet). I can feel this coming so I have asked him about the money a few times, he said he would give it to me as soon as he got all of these disability checks, and now the story is taxes. But I'm afraid he will kick me out and leave me with nothing. Is there anything I can do? What if he denies me access to his house? There was no contract signed and it's his house. Any suggestions are much needed and greatly appreciated, thanks.

    At best you have a possible month to month tenancy with this fellow. He would have to go through the eviction process to get you out. He can't simply kick you out.

    Have you considered just writing off the $3K you gave him; you've lived in a place rent free for over 2 years and that $3000 at 24 months would come out to a rent of only $125 a month. Pretty cheap living. And I'm sure you enjoyed the new $1800 refrigerator.

    If you believe the friendship is coming to an end, best to start looking for another place to reside.

    Your friend isn't going to pay back this money because he doesn't have it and never will.

    What is the eviction process?

    And yeah, I get I am living for free and $3000 for 2 years isn't expensive for rent, however he put me through this. I had a choice of staying with my parents for free or moving out, I chose moving out, that's the only reason why I'm so mad about this situation. I honestly don't like that fridge, it doesn't fit with the house, it's one of those huge ones. One thought I had in mind was taking that fridge with me, because it is my property, correct? If I can prove I bought it, would it belong to me?

    I am looking around, I'm just mainly worried about the $3000 and my belongings.

    The eviction process can be handled a couple of different ways...

    Your friend can hand you a notice to move out within a certain number of days (typically 30) which gives you time to find another place to live. If you stay longer they have to begin the LEGAL process of eviction by filing to do so with the court system in your county.

    Why would you haul around an $1800 refrigerator that you don't even like?

    Thank you for your response.

    That makes me feel a little safer, I would at least have some time to move and get all my stuff. The fridge, I was only going to use it as a way for him to pay me or I take it, and probably sell it. It's brand new and really nice. I can store it somewhere for a few months. But I'm mainly curious as if technically it is mine or not.

    And another topic into the conversation, what happens if he locks me out? Changes the lock so I can only get in the house when he's around. I doubt it will go to that extreme but I'm trying to get all of my ground covered before the big day.

    One more thing I would like to ask, how can I create a legal document where we can both sign it showing that he owes me X amount and will pay back within a time frame?
