    Default Possible Bigamous Marriage by an Immigrant

    My wife (Salvadorean born) and I (US born) have been married for 4 years and together for 8. We don't live together because she is finishing her studies in El Salvador. The last time we saw each other was on Jan. 2015, when she arrived on her tourist visa. Unbeknownst to me, she traveled to the US July 2015 through Oct. 2015 and returned to El Salvador. Her sister told me that my wife got married in the US with someone she met that year and on her marriage license my wife stated her marital status as single. My wife eventually, informed me that she wanted to end our relationship when she returned to El Salvador in Oct. 2015. We are currently still married and undergoing the divorce process.

    How serious are the consequences from the choices my wife has made, if she proceeds in obtaining her green card?

    Have YOU filed the I-130 for her to get a green card? She's not getting one based on her "marriage" to you unless you do so.

    If you never filed an I-130, you're divorcing, and she now lives in El Salvador with somebody who she may have married before her divorce from you was final, it would seem reasonable to say that the question of her getting a Green Card is a non-starter.

    We never got the process started because it would affect her not finishing her studies.

    She is currently in the US. Her new spouse has permanent residence.

    The visa time for F2A from El Salvador is running about 18 months right now. You can probably point out the bigamous marriage to CIS if you want I guess. Her divorcing you doesn't make her marriage to him any more legal at this point (though all she has to do is marry him again once she is divorced).

    Not a goal, just concerned if she has ruined her chance of obtaining permanent residence because she married her new spouse, while still being married with me and she falsely stated her marital status as single in her marriage license with her new spouse.
