    Default Can Your Landlord Ask You to Renew a Lease Five Months Before it Ends

    My question involves landlord-tenant law in the State of: Indiana

    I am renting an apartment in Indiana with a yearly lease that expires July. The company that manages the property is asking me to renew the lease by Feb 12. This is 5 months before the end of my lease and I find it ridiculous to be renewing this early. Is this legal?

    There is no law prohibiting the landlord from asking for an early renewal. However, if you refuse the landlord cannot terminate your lease prior the stated end of the lease term in the contract so long as you do not breach the lease.

    The landlord can also opt not to renew your lease, and to look for a replacement tenant to take over the unit after your lease ends.

    It's legal to "ask" and it's legal for you to accept.

    If you like where you are living why don't you ask management what's in it for you to renew early?

    Better terms, reduced rent or lock in current rent if already favorable, lower deposit, better parking space, or anything else you can think of.

    Otherwise you are free decline the request and renew later.

    barring the possibility of some enforceable clause obligating a landlord to allow a renewal IF the landlord extends the invitation to renew. Otherwise the landlord has the option of saying; nope, you had your chance.
