    Default Can you claim married people?

    We live in Georgia. From Jan 2005-June 2 I lived with my grandmother.My husband lived with his brother.Both our mothers did not support us but had custody.my father was paying child support to my mom but i never recieved anything from it.my husbands father never paid child support...we got married on June 3,2oo5...i was 5 moths pregnant..we immediately moved into my husband's mothers' trailer and paid her rent. In August and march me and my husband both turned 17..but we were married and emancipated...we had our child in October 2005...we both worked in 2005...when we went to claim our income taxes for 2005 we found out that my mother claimed me and my husband's mother claimed our son and my husband's father claimed him and my husband had not talked to him in over a year( my husband's parents are divorced) can they legally do this?....my mother-in-law also stole our W-2's from us and the police said it was a civil matter. I dont believe it was a civil matter....please tell us if it is legal what they did to us..

    It was not legal for your mother to claim you.
    It may have been legal for your husband's father to claim him, and for your husband's mother to claim your child.

    It really depends on how much money the two of you made, how much you paid in rent, and whether or not you can legitimately claim that you and your husband provided more than 50% of the support for both of you and your son.

    Go back to your previous employers and get new copies of your W2s. Take those and go get a consult with a local tax professional. If you can demonstrate that you legitimately provided more than 50% of your own support, then you can amend your 2005 joint return, receive your refund, and your mother, and both of your husband's parents will have to pay back the refunds that they fraudulently received.

    how would it be legal for my husband's father to claim him when he was ordered to pay child support but did not and my husband only lived with him for less than a year back in 2004?..my husband has had no contact with his father whatsoever...even if we did not provide 50% of support to our child (but we did) how can someone else claim him if they themselves did not provide that percentage or no percentage at all?

    also..we paid the bills at the house we rented but we were only 17 at the time so the bills could not be in our name what do we do about that? we got screwed out of our money..In March 2005 my husband and I filed our income tax and the Tax Return place gave us a set amount that we would get back.We set it up to be sent to my checking account and they told us it would be there in 3 weeks.After 4 weeks,I called the Tax Return place and they looked up our social security #'s and told me that we had already been claimed and that we were not getting our money that they told us we would get.If we were claimed why did they not tell us that from the beginning??I'm sure it would have showed up in their computer.What happened?

    The tax man has no way of knowing if someone else claimed you as a dependant.
    Only the IRS would know, when the same dependant was claimed more than once. It set off a red flag.
    Call the IRS, and explain whats going on. Be direct and to the point. They will help you, or at least tell you where to go next.
