    Default attorney costs

    My attorney is saying he may have to withdraw on my case because he needs more money. It has become more complicated than we anticipated, and I do not have the ability to give him what he wants up front. What will the courts do about this, we have a hearing coming up this month. Will they postpone or proceed even if I do not have an attorney.

    Default Replacing a Lawyer

    That depends upon the court, how much notice you have received of your attorney's intention to withdraw, and what (if any) benefit would result from an adjournment. For example, if you are not going to hire a new lawyer, a court is likely to question if there is anything to be gained from an adjournment. But if you are in the process of hiring a new lawyer, or have just hired a new lawyer, the court may be inclined to grant an adjournment to allow the new lawyer to become acquainted with the case.
