    Angry Employer Wants an Explanation of Past Criminal Charges

    My question involves labor and employment law for the state of: New York. I was hired for a position and filled out the application on the airplane en route abroad. I was hired with 2 days notice to fly overseas. They Fed Ex the application which I received en route to the airport.The application had a question if I was convicted of a crime within 7 years. I answered No. I have a misdemeanor theft charge that is at least 5 years old. I didn't disclose. The employer found 4 similar charges that are from 1986, 1990, 1993 and 2010. The employer is seeking explanation as to why I didn't disclose. The want details of the crime and explanation of my rehab. Of course I am very embarrassed and don't know what to tell them. Meanwhile, I'm working for them 70-90 hours a week in a tough job and am totally exhausted. Please accept my request for the best response to their query. Thank you.

    embarrassed? You should be ashamed of yourself. You get embarrassed when you have toilet paper stuck to your shoe. Stealing is shameful

    and apparently a regular thing for you.

    Given your name, I hope the sandwich you stole was at least a vegetarian sandwich.

    Thanks for your reply. I will respond. I was seeking thoughtful advice on the best response. i am working very hard on the job. I am qualified and it is super demanding. I would like to have this behind me. I can't do anything about my past but can seek a better future.

    I am well aware that either party can terminate for any reason at any time. I am making allot of billable hours for the company so I think they are willing to listen to my explanation.

    Since I do not know the employer, I do not know what they would consider an acceptable reason for you to lie to them.

    I can tell you that you are never safe in assuming they will not check; you are always safe in assuming that an employer will be more open to hiring someone who is honest about the mistakes they have made in the past, than they will someone who lies to them.

    It looks like you've been given a choice. You can either tell them or not. If you don't, they can fire you instantly. Actually they can fire you anyway.
