    Default How to Verify Employment With a Company That is Out of Business

    My question involves labor and employment law for the state of: California

    My unemployment claim which was approved by an unemployment hearing in Los Angeles switched over to a Short term disability claim some months ago. This went smoothly with no hiccups.

    Recently I've been receiving calls from an EDD auditor asking whether I was a 1099 employee or a W2 employee of the company paying the UI claim. I was never a 1099 employee with this company, and I sent him a copy of the appropriate W-2 as he requested. The problem is that EDD wants him to verify with the company itself that I was only a W2 employee, and the company no longer exists. The auditor closed out his part of the the claim audit, reporting that I was a W2 employee. But as far as the EDD is concerned the company hasn't been verified so SDI benefit payments are indefinitely frozen.

    What is the protocol in this situation? What can I expect and are there any steps I can take to facilitate payments starting again?

    Maybe if you got an income transcript from the IRS for that year that would help in convincing the EDD.
