My question involves criminal law for the state of: New York
Summary. A coworker physically hit me on my hand when I tried to explain to him and touched his computer mouse. This happened a few months ago I was subsequently terminated from my job.
What am I looking for? Pursue assault and battery charges as I'm still within the statute of limitations with in New York State.
Evidence:
Although there are no witnesses to him hitting me. There multiple supporting evidence of that show the man was hostile intone on email. He competed for projects on email. Using aggressive but not foul language on email. Not sharing information on projects. He also took advantage of my disability.
Questions
1. Can I still pursue charges ?
2. What evidence does a prosecutor need ? Can my attorney request for emails with my employer.
3. Likelihood of success
