    Default Can a Landlord Let Somebody Else Use a Tenant's Address for Mail

    My question involves civil rights in the State of: Kentucky

    I am not sure if this is the right forum for this but i have a question...

    My landlord has been using my address against my knowledge for someone that doesnt even live at my apartment.

    This person is using my address to receive food stamps and other government support.

    I have received several legal documents for this person as well such as summons and court dates for felony charges.

    My question is, Is this illegal? I did not give any consent to this nor was i made aware of this. I am worried this will some how bite me in the ass.

    Of course it not legal if done intentionally . But who are the benefits and summonses made out to? Just because the address is yours doesn't mean that you are being served.

    Go to court and explain that you are not the person that is named in the summonses.

    Do you want to spend $300 per hour on an attorney and go to court, report it to the Post Office where your complaint will go into the trash bin, pick a fight with your landlord over something petty?

    From a practical standpoint, I suggest you just mark the envelopes return to sender, address unknown, take a picture, and throw it back in the mail.

    Nothing's going to bite you in the butt.

    Why do you say it's your landlord using your address in this fraud?

    how do you know what was recieved if you were not the addressee? Opening mail that isn't yours maybe?

    what you are supposed to do when recieving mail addressed to your resident but with a name unknown to you is to mark the mail addressee unknown and return it to the postal service. Especially for legal mailings and official government mailings the sender will need that information to determine actions dependant on the mailing.

    I have called my local court house explained the person does not live here. But still every now and then ill have the police show up at my door looking for this person.

    I know what the mail is because i have a friend who is on government assistance and it is in the same envelope and general layout as his. And the legal summons say what the mail is without even having to open it. I would never open someone else's mail, my landlord when i first gave him mail for this person opened the mail himself that is how i know that some of the mail had court dates.

    Just because the sender is the same party it does not mean it contains the same information within.

    and regarding the summons: sorry but this information is only available by opening the envelope;

    that means you have opened and read mail not intended for you. That action is one reason this problem continues. If you keep opening others mail and not returning it the sender is going to assume they are sending it to the correct address. Not only are you violating others privacy, you could be causing a possibly innocent party to be subjected to improper judgments or even criminal charges since a refusal to respond properly mailed summons could result in default judgments in civil suits and criminal charges for failure to appear if it involves criminal issues.

    That may be one reason the police keep showing up to your residence looking for somebody that you claim doesn't live there.

    So, start with returning the mail that isn't yours.

    Then, you implicated your landlord in this ruse but have failed to explain why you believe that so, why do you believe that?

    Ok so ill say it again... i have called and let them know that the person doesnt live at this address.... Again i did not open anyone's mail my landlord did when i confronted him about this persons mail. I simply need to know which in the form of "yes or no" would be appreciated, if this is illegal.

    Why have you chosen not to answer that question?

    Lots of people who rent homes find that they receive mail for a former occupant. As you were told, you can mark the mail "Return to Sender, No Longer at This Address". You can also affix a note to the inside of the door of your mailbox stating, "John Doe does not live at this address", and can talk to your mail carrier about the issue.

    Is it illegal for somebody to fail to register forwarding addresses with government agencies, the courts, and others who may want to send them mail? No, but it's a bad idea. If that's what a former tenant chooses to do, it's also not your landlord's fault.

    Presumably because you live at the person's last known address.

    calling doesn't mean squat.

    return rhe mailings marked addressee unknown; return to sender

    without knowing everything about the situation all that can be said is it might be legal or it may not be legal. It surely hints at some illegal activity but that is all.

    You have still not stated why you believe the landlord is involved in this.

    you can buy a return to sender stamper at any office supply store for 10 bucks or less, or if the mailings are infrequent just write it on them or run a sheet of return address stickers through your printer with

    RETURN TO SENDER
    NOT AT THIS ADDRESS
    on them.
