This happened in the State of PA.
The other day my 20 year old friend went to get alcohol. I went with him. He picked another person up (23 years of age). I was in the backseat of the car. The 23 year old went into liquor store bought alcohol and came back out. We drove person home and dropped them off. As soon as 23 year old stepped out of the car without the bag and started to walk into building the undercovers surrounded our car. I was still in the back seat with the alcohol in the middle console between driver and passenger seat. The cops took both me and the driver's licenses to cite us for possession of alcohol as well as gave the 23 year old charges for buying alcohol for minors. I never touched the alcohol and the alcohol was never opened (still in bag). No one was ever asked who's alcohol it was.
Do i deserve an "underage" citation for just being in the backseat?
Does the person driving deserve an underage as well for driving with a person of age in car?
