    Default Applying for Unemployment After Losing a Primary Job and Moving

    My question involves labor and employment law for the state of: California

    had a job on campus in Berkeley but graduated and moved back to SoCal on December 18th 2015

    I'm still technically employed by Berkeley and haven't formally resigned

    looking for a job but have some bills that need to be paid

    the job on campus was part time and I only worked 4-8 hours per week, if that

    should I file partial unemployment or unemployment or am I disqualified ?

    You don't have to resign. You abandoned the job a month ago and that's what your former employer will say when they respond to your UI claim.

    My guess is that you are ineligible for UI but feel free to file for it and see how it goes.

    they scheduled me to work a few hours this week, but i told them that i'm still in LA

    the assumption is that i may return spring 2016, unless i submit a formal resignation, so i'm still technically employed

    i was reading somewhere that individuals that work a small amount of hours may still be eligible for unemployment, so i'm just wondering what i should file or if it will be a waste of time

    the position is seasonal/by semester, as it's an on campus/student job, and they only use us if there is a need, so we sometimes go weeks without work, and then during finals week, we get about 20 hours

    Spin it any way you like but you left the job voluntarily and have just refused an offer of work, either or both of which could disqualify.

    Apply anyway and see how it goes.

    Unemployment is also based on the amount of wages you made in the first four of the last five completed quarters, working for a covered employer. A lot of part time university positions such as work study and graduate assistantships are not paid for by covered wages to begin with. Even if the wages were covered, there are not going to be many of them in any quarter. This means that your claim, if you do set up a claim, will be very small. And you did abandon the job as of the middle of December. Thus when the unemployment system inquires and you respond that you moved when the semester was over, and the university says you voluntarily quit the job, you won't be likely to be approved. So it's not really an option.

    Partial unemployment is not something you have to specify when you apply. Just file a claim. Partial unemployment what you get when you are employed and working part of the time and drawing a reduced amount of benefits for part of the time. Since you are no longer employed by the university, not working at all there (though you have not "formally" resigned) you would not be drawing partial unemployment, even if you are approved to draw.

    okay, thanks to you both

    seems like it would be pointless

    i saw the minimum at $40, which is about what i need to cover my car insurance, so the small amount would've still been helpful

    i'll just continue applying for work and waiting for interviews

    my unemployment claim was approved

    however, I did not make enough money to receive any reward

    only made $3200 last year, so my weekly benefit about is $0
